Terms & Conditions of Hire

1. About these Terms

These Terms & Conditions ("Terms") govern the hire of equipment from Easy Hire ("we", "us", "Easy Hire"), located at 32 Timandra Place, Blenheim, New Zealand. By submitting a hire request through this website or collecting equipment from us, you ("the Hirer") agree to these Terms. These Terms operate alongside the Consumer Guarantees Act 1993 and other applicable New Zealand law.

2. Bookings & quotes

Submitting the online hire form is a request, not a confirmed booking. Equipment is reserved only once we contact you to confirm availability and pricing. Prices shown on the website are guides only and are subject to change without notice; the price quoted at booking applies.

3. Hire period & returns

The hire period begins when the equipment leaves our premises (or is delivered) and ends when it is returned to us in the same condition. Equipment returned after the agreed end time is charged at the applicable late rate. {Late return charging policy to be confirmed.}

4. Deposits & payment

{Deposit, bond and accepted payment methods to be confirmed.} All charges are payable in New Zealand dollars and include GST unless otherwise stated.

5. Use of equipment

The Hirer agrees to use the equipment only for its intended purpose, within its rated capacity, and in accordance with manufacturer instructions and any guidance we provide. The Hirer must not allow any person to operate the equipment unless they are competent and (where applicable) appropriately licensed.

6. Damage, loss & liability

The Hirer is responsible for the equipment from the moment of collection (or delivery) until it is returned. The Hirer is liable for the cost of repair or replacement of any equipment that is lost, stolen or damaged during the hire period, except where the loss or damage results from normal fair wear and tear or our own negligence.

7. Fuel, consumables & cleaning

Equipment is supplied with a full tank of fuel where applicable and must be returned full. Equipment returned dirty or with consumables missing may incur a cleaning or restocking charge. {Cleaning and refuel rates to be confirmed.}

8. Cancellations

9. Breakdowns

If equipment breaks down through no fault of the Hirer, the Hirer must stop using it and notify us immediately on 022-195-0588. We will repair or replace the equipment as soon as reasonably practical and credit any hire charges for the time the equipment was unavailable. Continued use of faulty equipment is at the Hirer's own risk and may transfer liability for any further damage to the Hirer.

10. Health & safety

The Hirer is responsible for site safety and for ensuring that any operator of the equipment complies with the Health and Safety at Work Act 2015 and any applicable codes of practice.

11. Consumer rights

Nothing in these Terms is intended to limit your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you are acquiring the equipment as a consumer (and not for the purpose of a business).

12. Governing law

These Terms are governed by the laws of New Zealand and any dispute relating to a hire is subject to the exclusive jurisdiction of the New Zealand courts.
